Profits Over Safety

As Kansas City personal injury lawyers who have been practicing for many years, we have seen a lot of corporations make bad decisions. Sometimes these decisions cause injury or death. Every time these decisions have been made because of money.

Unfortunately, the vast majority of corporate decisions are based on money. Almost universally they make choices based on what will make them the most money. These decisions can cause us harm; they can kill or injure us or take away our money or freedom. When a company makes decisions that put profits over safety, and as a result someone gets hurt, the company is not only responsible for the harm they caused, but they must also be punished.

In Missouri, if a company shows complete indifference to or conscious disregard for the safety of others, then they must pay punitive damages. These damages are meant to punish the company and to deter it and others from like conduct. When awarded at trial, they are in addition to any compensatory damages. Half of all punitive damages awards go to the State.

When a company puts profits over safety, it is showing complete indifference to and conscious disregard for our safety. An example of this would be overworking and underpaying employees. This can lead to corners being but, even on safety. Companies often know this because their employees complain to HR. But they still choose to ignore it. This is when punitive damages are warranted.
