Be Careful What You Share on Facebook & MySpace

I recently learned from a colleague that some insurance defense firms are now accessing clients' Facebook and other social networking profiles to try and dig up information that can be used against them in their personal injury case. I have also learned that some firms may also be creating bogus profiles and sending friend requests to injured clients in order to access their profiles.

I'm sure you've heard this before, but be careful about what you post to your online profiles, whether public or private. It might be the first time, however, that you've heard this admonition in the context of personal injury cases. Insurance companies will do whatever it takes to short change you on your injury claims, including snooping around your Facebook or MySpace profiles to find information they can use against you. For example, if they can find a picture or comment that suggests you are not as hurt as you say you are, they will use that to pay you less for your injuries.

I tell every one of my clients that they must remove any content on their social networking profiles that can be used against them in their case, even if their profiles are private. You might want to think about doing the same.
