Matt Meyerkord Wins Plaintiff Verdict in Hazardous Fall Case

Meyerkord Russell & Hergott won a jury verdict for their plaintiff who was injured in a slip and fall accident in Kansas City, Missouri.

A jury sided with the plaintiff, represented by Matt Meyerkord of Meyerkord, Russell & Hergott and co-counsel Nick Hergott.

The plaintiff, a 43-year-old female, was walking in a crosswalk near a Kansas City, Missouri hospital where she worked when she slipped on the ice in freezing temperatures. She suffered aggravation of herniated and bulging discs which resulted in lumbar surgery.

The plaintiff stated that eight complaints had been made over five years, including one from a hospital security guard, about a water leak in the area. Six visits were logged to inspect the water leak.

The plaintiff sought damages for her injuries resulting from the slip. The defendant did not admit fault and claimed that the plaintiff did not keep a proper lookout, failed to mitigate, had a pre-existing condition and did not show that leaking water came from the City’s pipes.

The jury found the plaintiff 40% at fault, and the defendant was found 60% at fault.

The demand before the trial was $100,000 and the offer was $10,000. The jury awarded the plaintiff $250,000 in damages, and the net recovery to the plaintiff was $150,000.
